{"id":2637,"date":"2023-12-19T19:44:59","date_gmt":"2023-12-19T19:44:59","guid":{"rendered":"https:\/\/just2air.com\/terms-and-conditions\/"},"modified":"2023-12-28T21:30:55","modified_gmt":"2023-12-28T21:30:55","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/just2air.com\/es\/terms-and-conditions\/","title":{"rendered":"Terms &#038; Conditions"},"content":{"rendered":"<div class=\"vc_row wpb_row vc_row-fluid\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\n\t<div class=\"wpb_text_column wpb_content_element  wpb_animate_when_almost_visible wpb_fadeInUp fadeInUp\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<h1 style=\"text-align: center;\">Terms &amp; Conditions<\/h1>\n<h4 class=\"text-center shortdescription\" style=\"text-align: center;\">When you book a flight with Jetair you agree to our general conditions of carriage for passengers and baggage<\/h4>\n<div id=\"el-1968\" class=\"cblock a1paragraph\">\n<div class=\"inner clearfix\">\n<article>\n<div class=\"text\">\n<p>&nbsp;<\/p>\n<\/div>\n<\/article>\n<\/div>\n<\/div>\n\n\t\t<\/div>\n\t<\/div>\n\n\t<div class=\"wpb_text_column wpb_content_element  wpb_animate_when_almost_visible wpb_fadeInUp fadeInUp\" >\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<p><strong><u>DEFINITIONS:<\/u><\/strong><\/p>\n<p><strong>Baggage<\/strong>\u00a0means both Checked Baggage and Unchecked Baggage, unless otherwise specified.<\/p>\n<p><strong>Baggage Allowance<\/strong>\u00a0means the maximum quantity of Baggage (in terms of number and\/or weight and\/or dimensions).<\/p>\n<p><strong>Charter ticket<\/strong>\u00a0means a ticket, in electronic forms or otherwise, issued pursuant to a Charter Contract.<\/p>\n<p><strong>Denied boarding<\/strong>\u00a0the refusal of any Passenger to carry on a flight, although the Passenger reported himself prior to boarding, without the deny boarding is being based on reasonable grounds that have to do with reasons such as health, safety or security or inadequate travel documentation.<\/p>\n<p><strong>Fare Excluding Tax<\/strong>\u00a0means the Fare charged to the Passenger, excluding Taxes and Issue Fees.<\/p>\n<p><strong>Fare Including Tax<\/strong>\u00a0means the Net Fare plus Tax.<\/p>\n<p><strong>Place of Departure<\/strong>\u00a0means the place of departure as shown on the Ticket.<\/p>\n<p><strong>Place of Destination<\/strong>\u00a0means the place of destination as shown on the Ticket.<\/p>\n<p><strong>Taxes<\/strong>\u00a0mean fees, taxes and charges imposed by governments, an airport operator or any other authority.<\/p>\n<p><strong>Service Animal<\/strong>\u00a0refers to any animal that is individually trained or is shown to have an innate ability to provide assistance to a Qualified Individual with a Disability.<\/p>\n<p><em>We<\/em>,\u00a0<em>our<\/em>,\u00a0<em>ourselves<\/em>\u00a0and\u00a0<em>us<\/em> means Just2air. <em>You<\/em>,\u00a0<em>your<\/em>\u00a0and\u00a0<em>yourself<\/em>\u00a0means any person, except members of the crew, carried or to be carried in an aircraft, having a ticket, including an electronic ticket, valid for the transportation. Airline code means the two characters which identify air carriers.<\/p>\n<p><strong>Charter Operations<\/strong><br \/>\nIf carriage is performed pursuant to a charter agreement, these Conditions of Carriage apply only to the extent they are incorporated by reference or otherwise, in the charter agreement or the ticket.<\/p>\n<p><strong>Unruly Passengers<\/strong><br \/>\nIn the event of an incident involving a disorderly passenger, to ensure the safety of the other passengers, Just2air may call the Airport Police or the police agency responsible for the case.<\/p>\n<p>When passengers demonstrate violent or unruly behavior onboard a Just2air aircraft and almost in every case, sympathetic handling and reassurance by the Cabin Crew is pursued to calm the passenger. However, where an unruly or violent passenger cannot be subdued, passenger restraint devices may need to be used. He\/she can delegate those powers to members of the crew and to passengers on board the flight.<\/p>\n<p><strong>Passengers Under Custody<\/strong><br \/>\nInadmissible passengers and deportees and any item they carry, whether accompanied by an escorting officer(s), shall be subjected to thorough security screening.<\/p>\n<p>Inadmissible and deportee passengers are persons, who are being removed by a country\u2019s authority, that have been the subject of judicial or administrative proceedings and are classified as follows:<br \/>\n\u2022 DEPU \u2013\u00a0<em>A deportee who does not require an escort during his\/her carriage (deportee unaccompanied)<\/em>.<br \/>\n\u2022 DEPA \u2013\u00a0<em>A deportee who requires an escort during his\/her carriage (deportee accompanied).\u00a0<\/em><br \/>\n\u2022 INAD \u2013\u00a0<em>Inadmissible is a person who has been refused (or will be) entry to the country for a variety of reasons<\/em>,<em>\u00a0the most common being the lack of proper documentation (e.g. due to problems with passport, visa etc.)<\/em>.<\/p>\n<p>Usually the carrier that transports the passenger into the country is responsible for their immediate carriage back to either the country of origin or departure.<\/p>\n<p>When circumstances such require inadmissible passengers may be escorted. Deportees under 12 years of age are not included in the number of deportees counted.<\/p>\n<p>For Flight Safety reasons, inadmissible and deportees exceeding 2 per flight, shall not be seated on board as a group, but separated.<\/p>\n<p>Immigration officer(s) or designated person(s) will bring INAD(s) and DEPU(s) to the aircraft in order to ensure their departure. The travel documents shall be handed over to the purser of the specific flight. The station of the final destination will be informed and upon arrival of the flight the security or designated person shall collect the travel documents from the purser and escort the INAD(s) and or DEPU(s) to the Immigration counter.<\/p>\n<p>DEPA \u2013 May be escorted by local policing authorities and or when directive is given by the Director of Security, by airlines security officers. They will be embarking the aircraft before other passengers and deplaned after all other passengers have disembarked.<\/p>\n<p><strong><u>1. TICKETS<\/u><\/strong><br \/>\n<strong>1.1<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Requirement for valid ticket<\/p>\n<p><strong>1.2<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 We will provide carriage only to the passenger named in the ticket and you may<br \/>\nbe required to produce appropriate identification.<\/p>\n<p><strong>1.3<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A ticket is not transferable.<\/p>\n<p><strong>1.4<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 When a ticket has been issued by us or by one of our agents on our behalf it is<br \/>\nand always remains our property.<\/p>\n<p><strong>1.5<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Except in the case of an electronic ticket, you shall not be entitled to be<br \/>\ncarried on a flight unless you present a valid ticket containing the flight coupon<br \/>\nfor that flight and all other unused flight coupons and the passenger coupon.<br \/>\nIn addition, you shall not be entitled to be carried if the ticket presented is<br \/>\nmutilated or if it has been altered otherwise than by us our authorized agent.<br \/>\nIn the case of an electronic ticket you shall not be entitled to be carried on a<br \/>\nflight unless you provide positive identification and a valid electronic ticket has<br \/>\nbeen duly issued in your name.<\/p>\n<p><strong>1.6<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A ticket is valuable, and you should take appropriate measures to safeguard<br \/>\nit and ensure it is not lost or stolen.<\/p>\n<p><strong>1.7<\/strong>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The ticket will not be honored and will lose its validity if all the coupons are not<br \/>\nused in the sequence provided in the ticket.<\/p>\n<p><strong><u>2. FARES, FEES, TAXES AND CHARGES<\/u><\/strong><br \/>\n<strong>2.1 General<\/strong><br \/>\nFares apply, only for carriage from the airport at the point of origin to the airport at the point of destination, unless otherwise expressly stated. Fares do not include ground transport service between airport and between airports and town terminals.<\/p>\n<p><strong>2.2 Fees, Taxes and Charges<\/strong><br \/>\nAll fees, taxes or charges imposed by governments, by any other authorities or by the airport operator shall be paid by the passenger. To the extent possible when making a reservation for their ticket, Passengers will be informed of said fees, taxes or charges, which will be charged in addition to the Fare Excluding Tax and which, in most cases, will be shown separately on the ticket.<\/p>\n<p>These fees, taxes, and charges may be created or increased by government, another authority , or by an airport operator, after the reservation date. In this case, the passenger must pay the corresponding amount. As soon as a passenger has paid and received a ticket then aforementioned fees, taxes and charges will not be charged or deducted.<\/p>\n<p><strong>2.3 Currency<\/strong><br \/>\nFares and charges are payable in the currency of the country in which the ticket is issued, unless another currency is indicated by us or our authorized agent at or before the time payment is made for example, because of the non-convertibility of the local currency.<\/p>\n<p><strong><u>3. RESERVATIONS<\/u><\/strong><br \/>\n<strong>3.1\u00a0<\/strong>Reservations are not confirmed until recorded as accepted by us or by our authorized agent.<\/p>\n<p><strong>3.2 Ticketing time limits<\/strong><br \/>\nIf you have not paid for the ticket within the specified time limit which we or our authorized agent have specified, we may cancel your reservations.<\/p>\n<p><strong>3.3 Personal Data<\/strong><br \/>\nYou recognize that personal data has been given to us for the purposes of making a reservation, purchasing a ticket, developing and providing services, facilitating immigration and entry procedures, and making available such data to government agencies in connection with your travel. For these purposes, you authorize us to retain and use such data and to transmit it to our own offices, authorized agents, government agencies, other carriers or the providers of the above-mentioned services.<\/p>\n<p><strong>3.4 Seating<\/strong><br \/>\nWe do not provide seat selection or allocation service. We reserve the right to assign or reassign seats at any time, even after boarding of the aircraft. This may be necessary for operational, safety or security reasons. Passenger may not occupy a seat other than the seat(s) to which Passenger is assigned except when so authorized or instructed by crewmembers on duty.<\/p>\n<p><strong>3.5 Cancellation of onward reservation<\/strong><br \/>\nIf you do not use a reservation, your return or onward reservations may be cancelled.<\/p>\n<p><strong><u>4. CHECK IN\/BOARDING<\/u><\/strong><br \/>\n<strong>4.1\u00a0<\/strong>Preferred check-in times are 90 minutes at all Just2air locations, and we request that you honor them. Your journey will me smoother if you allow yourself ample time for check-in. Please note that airlines reserve the right to cancel reservations of passengers who arrive at a check-in desk later that the times indicated.<\/p>\n<p><strong>4.2<\/strong>\u00a0You must be present at the boarding gate not later than the time specified by us when you check in.<\/p>\n<p><strong>4.3<\/strong>\u00a0We may cancel the space reserved for you if you fail to arrive at the boarding gate in time.<\/p>\n<p><strong>4.4<\/strong>\u00a0We will not be liable to you for any loss or expense incurred due to your failure to comply with the provisions of this Article.<\/p>\n<p><u><strong>5. BAGGAGE<\/strong><\/u><br \/>\n<strong>5.1 Baggage and Special baggage<\/strong><br \/>\nPlease refer to our baggage rules and regulations on our Website.<\/p>\n<p><strong>5.2\u00a0Payments of extra checked baggage<\/strong><br \/>\nRefunds of payments made for extra checked baggage without usage, should be requested not later than two (2) weeks after scheduled departure. Claims received after two (2) weeks will not be honored.<\/p>\n<p><strong>5.3\u00a0Lost or damage of checked baggage<\/strong><br \/>\nIf you wish to file a claim or an action regarding damage to checked baggage, you must notify us as soon as you discover the damage before leaving the arrival hall.<\/p>\n<p>Please note:<\/p>\n<ul>\n<li>Just2air will not cover damaged wheels, zippers and\/or handles of baggage;<\/li>\n<li>Just2air will not cover damages on hard case suitcases which are vulnerable to damage.<\/li>\n<\/ul>\n<p><strong>5.4\u00a0Late or no arrival\u00a0of\u00a0checked baggage<\/strong><br \/>\nJust2air offers a compensation for basic needs of USD 25,- per day for each calender day a passenger spend abroad without their checked baggage due to late or no arrival of checked baggage. Compensation is only for non residents at destination.<\/p>\n<p><strong><u>6. TRAVELLING WITH CHILDREN<\/u><\/strong><br \/>\n1 diaper bag max. 5 KG, must fit under seat in front of you.<br \/>\n1 FAA approved car seat OR 1 FAA approved stroller removable seat.<br \/>\n<em>*only possible in combination with booked window seat.<\/em><\/p>\n<p><strong>UNACCOMPANIED MINORS\/ YOUNG PASSENGERS PER LEG<\/strong><br \/>\n-Unaccompanied minors\u00a0 \u00a0 \u00a0 \u00a08-11 Years<br \/>\n-Young passengers\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a012-17 Years<\/p>\n<p>UM fees need to be paid in advance.<br \/>\nUM fees are\u00a0are non refundable.<\/p>\n<p><strong>SPECIAL ASSISTANCE:<\/strong><br \/>\nSpecial assistance through your trip. DELAYS AND CANCELLATIONS OF FLIGHTS<\/u><\/strong><br \/>\n<strong>7.1<\/strong>\u00a0The Carrier will take all reasonable measures to avoid delay in carrying the Passenger and their Baggage. In order to prevent a flight cancellation or delay, Carrier may arrange for a flight to be operated on its behalf by an alternative Carrier and\/or aircraft and\/or other means of transport.<br \/>\nPassengers are not entitled for a refund if one of above has been arranged for their trip.<\/p>\n<p><strong>7.2\u00a0<\/strong>A Passenger whose flight is cancelled by Just2air will receive, at the Passenger\u2019s option, a full refund or re-accommodation on the next available Just2air flight in the same class of service at no additional charge or fare, except when a portion of the trip has been made. Any refund will be made in an amount equal to the applicable one-way fare for the portion of the trip cancelled or not operated as scheduled by Just2air.<br \/>\nRefund of COVID-19 tests to be made within two (2) weeks after cancellation of flight.<\/p>\n<p><strong>IMPORTANT:<\/strong><\/p>\n<ul>\n<li><em><strong>Just2air is not responsible for misconnections with other Carriers nor for booked accomodations and car rentals.<\/strong><\/em><\/li>\n<li><strong><em>All expenses for reimbursement must be submitted within 2 weeks after the flight cancellation.<\/em><\/strong><\/li>\n<li><strong>\u200b\u200b\u200b\u200b\u200b\u200b\u200bJust2air<\/strong> <em><strong>tickets will remain\u00a0valid for one (1) year if refund request is not submitted within one (1) month of affected flight.<\/strong><\/em><\/li>\n<li><em><strong>Just2air cannot be held responsable for cancellations due to border closures and\/or government measures.<\/strong><\/em><\/li>\n<\/ul>\n<p><strong><u>8. GROUP RESERVATIONS<\/u><\/strong><br \/>\nGroup Reservations must be made through our Ticket Office when ten (10) or more Passengers are booked as a group traveling on the same itinerary. Refundable fares are not available for group reservations. If a group reservation is canceled within twenty-four (24) hours of booking and such reservation is made one week or more prior to the flight\u2019s departure, payment will be refunded in full without assessment of a cancellation fee. Such refund will include any deposit that a party or individual is required to make at the time of booking. Such group reservations are subject to all applicable group policies and procedures established by Carrier.<\/p>\n<p><strong><u>9. DANGEROUS GOODS<\/u><\/strong><br \/>\nFederal law prohibits hazardous materials from being included in either checked or carry-on baggage. Items such as explosives, compressed gases, oxidizers, corrosives, flammable liquids and solids, loaded firearms, radioactive materials and poisons are considered hazardous. Some common examples of prohibited items include paints, mace\/tear gas, lighter fluid, oxygen bottles and fireworks. Other common items that may be carried, in limited quantities, within baggage include hairspray, perfume, and certain medicines that the Passenger must use during flight. Dry ice will be accepted within carry-on or checked baggage if the dry ice is contained in a package that (a) allows the release of carbon dioxide, (b) is plainly marked with the words \u201cdry ice\u201d or \u201ccarbon dioxide solid\u201d together with the net weight of the dry ice and the name of the contents being cooled, and (c) the package contains less than five and a half (5.5) pounds of dry ice.<\/p>\n<p><strong><u>10. WHEELCHAIRS AND WHEELCHAIRS BATTERIES<\/u><\/strong><br \/>\nCarrier will accept wheelchairs, whether manually operated or battery operated, as checked baggage on the same flight as the Passenger who uses the device, unless the Passenger requests stowage of his or her manual wheelchair within the cabin (subject to the specific aircraft configuration or other applicable limitations).<\/p>\n<p>If a manual wheelchair, mobility device or other Assistive Device cannot be stowed in-cabin, Carrier will transport them in the baggage compartment.<\/p>\n<p>Carrier will accept additional wheelchair batteries and battery-powered wheelchairs with the battery attached if the battery is labeled by the manufacturer as non-spill able. Batteries lacking non-spill able manufacturer labeling and spill able batteries that cannot remain in an upright position must be placed in special shipping boxes. Due to the advance notice requirement that may apply to obtaining these boxes, Passengers should advise Carrier at least forty-eight (48) hours before scheduled departure of the need for an appropriate battery box. Carrier will accept lithium batteries for in-cabin stowage with terminals taped or enclosed in a case. For stowage in the baggage compartment, only lithium batteries whose terminals are completely enclosed in a case are permitted, all others must be removed from the device and stowed in the cabin. Damaged or leaking batteries will not be transported.<\/p>\n<p><strong><u>11. SMOKING<\/u><\/strong><br \/>\nSmoking aboard the aircraft is prohibited in accordance with Federal Law.<\/p>\n<p><strong><u>12. REFUNDS<\/u><\/strong><br \/>\n<strong>12.1\u00a0<\/strong>We will refund a ticket or any unused portion in accordance with the applicable fare rules as follows:<\/p>\n<ul>\n<li>A refund, where it is authorized by the Ticket\u2019s fare conditions, will be paid based on Fare including Tax paid for the ticket.<\/li>\n<li>Request for the refund of a ticket must be submitted to the issuer of the ticket.<\/li>\n<\/ul>\n<p><strong>12.2\u00a0Involuntary refunds<\/strong><br \/>\nIf we cancel a flight, fail to operate a flight reasonably according to schedule, fail to stop at your destination or stopover or cause you to miss a connecting flight on which you hold a reservation the amount of the refund shall be:<\/p>\n<ul>\n<li>If no portion of the ticket has been used, an amount equal to the fare paid.<\/li>\n<li>If a portion of the ticket has been used, the refund will be not less than the difference between the fare paid and the fare for the transportation used.<\/li>\n<\/ul>\n<p><strong>12.3\u00a0Voluntary refunds<\/strong><br \/>\nIf you are entitled to a refund of your ticket for reasons other than those set out in Article 12.1 the amount of the refund shall be:<\/p>\n<ul>\n<li>If no portion of the ticket has been used, an amount equal to the fare paid less any reasonable service charges or cancellation fees.<\/li>\n<li>If a portion of the ticket has been used, the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the point for which the ticket has been used, less any reasonable service charges and cancellation fees.<\/li>\n<\/ul>\n<p><strong>12.4\u00a0Right to refuse refund<\/strong><br \/>\nWe may refuse a refund where application is made after the expiry of the validity of the ticket.<\/p>\n<p><strong>12.5\u00a0By whom ticket refundable<\/strong><br \/>\nVoluntary refunds will be made only by the carrier which originally issued the ticket or by its agent if so authorized.<br \/>\n<strong>IMPORTANT:<\/strong><\/p>\n<ul>\n<li><strong><em>All expenses for reimbursement must be submitted within 2 weeks after the flight cancellation.<\/em><\/strong><\/li>\n<li><strong><em>Just2air\u00a0 tickets will remain valid for one (1) year if refund request is not submitted within one (1) month of affected flight.<\/em><\/strong><\/li>\n<\/ul>\n<p><strong><u>13. GENERAL INFORMATION<\/u><\/strong><br \/>\nJust2air will notify passengers of the following: known delays of thirty (30) minutes or more, cancellations, and diversions.
